INTRODUCTION

These User Terms and Conditions apply to any use of ALOHA GO-KART Website and services (hereinafter: 'the Platform'). Please read these User Terms and Conditions carefully before accessing and/or using the Platform.

By using this Platform, you (hereinafter also: 'User') confirm that you have read, accepted and agree to be bound by these User Terms and Conditions, including liabilities and the applicable law. If you do not agree to these User Terms and Conditions, do not access, use and/or contribute to the Platform.

We reserve the right to unilaterally change these User Terms and Conditions, whenever it deems necessary. It is your responsibility to periodically check these User Terms and Conditions for changes. The continued use of the Platform will be deemed acceptance of the updated or amended User Terms and Conditions.

ARTICLE 1 'GO-KART TOUR REQUIREMENTS'

International Driving Permit (IDP): You must ensure your International Driving Permit is valid in Japan before making a reservation. You cannot participate with photos or digital copies. Please bring your passport and IDP on the day of the tour.

Valid Documentation: The customer has an obligation to provide a valid IDP. If your IDP is not valid in Japan, you cannot participate and we will not issue a refund.

Costume Policy: We do not provide any NINTENDO Mario Kart costumes, due to the Unfair Competition Prevention Act.

Safety Requirements: All participants must follow traffic rules and safety instructions. Tours may be cancelled due to weather conditions or safety concerns.

ARTICLE 2 'CONDITIONS TO USE THE PLATFORM'

You are obliged to comply with the provisions of these User Terms and Conditions and any further instructions or directions from ALOHA GO-KART.

You are solely responsible for verification of the reliability, accuracy and relevance of the information and data available on this Platform.

When making a reservation through the Platform, you represent and warrant that the information provided by you is accurate, complete, reliable and up to date.

You may not upload or transmit viruses or other malicious codes or disrupt the functioning of the Platform.

ARTICLE 3 'INTELLECTUAL PROPERTY RIGHTS'

Unless stated otherwise, all rights, including copyrights and other intellectual property rights to the Platform – including look and feel, layout, designs, images, programs, technical set-up, navigation and system features – remain with ALOHA GO-KART.

These User Terms and Conditions do not constitute any license for you to use the trademarks of ALOHA GO-KART and the corresponding logos.

You may consult the information on the Platform for your personal use. Any other use, including distributing, modifying, storing, reproducing, or commercializing the Platform content, is not permitted without express written permission.

ARTICLE 4 'LIABILITY'

ALOHA GO-KART shall not be held responsible or liable for any damage or losses resulting from the use or inability to use the Platform, such as incorrect, incomplete, or unlawful information.

The Platform may contain links to external websites. ALOHA GO-KART is not liable for the content of external websites.

ALOHA GO-KART shall not be held responsible for damage resulting from any activities of User on the Platform.

The Platform may contain references to services that have not been announced in your country. These references do not imply intention to announce such services in your country.

ARTICLE 5 'APPLICABLE LAW AND COMPETENT COURT'

The use of the Platform and these User Terms and Conditions are governed exclusively by Japanese law.

Any disputes arising from the use of the Platform and these User Terms and Conditions shall be submitted exclusively to the competent court in Tokyo, Japan.

You agree that the period for filing any claim against ALOHA GO-KART shall be one (1) year from the origin of the claim.

ARTICLE 6 'MISCELLANEOUS'

ALOHA GO-KART processes personal data of Users and cookies on the Platform. For more information, please see the Privacy Statement and Cookie Policy.

ALOHA GO-KART reserves the right to change, modify, add or remove portions of these User Terms and Conditions at any time.

If any provision of these User Terms and Conditions should become ineffective, invalid or unenforceable, the remaining provisions shall remain in full force and effect.

The English version of these User Terms and Conditions is the only official and legally binding version.

ARTICLE 7 'PRIVACY POLICY'

ARTICLE 8 'Others'

Fees Other Than the Price of the Service:
Customers may optionally purchase an additional liability waiver insurance on-site. The cost is JPY 1,000 or less and is optional. If the customer chooses not to purchase the optional waiver insurance and causes damage to the vehicle due to their own negligence, a Non-Operation Charge (NOC) of JPY 50,000 will be charged. Additional repair costs necessary to restore the vehicle may also be billed separately. Depending on the insurance the customer already carries, some coverage may apply; however, such insurance may also be deemed non-applicable depending on the circumstances.


Refund Policy:
Cancellations made by 12:00 PM (noon), Japan Time, on the day before the scheduled experience
will incur no cancellation fee.
To cancel, please contact us using the listed phone number or email address.
Cancellations made after 12:01 PM on the day before the tour will incur a 100% cancellation fee.

If the tour cannot be operated due to natural disasters (heavy rain, snow, typhoons, earthquakes, etc.),
a full refund will be issued.
However, no refund will be provided if the tour cannot be operated due to reasons attributable to the customer.

Examples include, but are not limited to:
Failure to bring a valid passport or valid driver’s license accepted in Japan
Presentation of invalid or counterfeit identification
Evidence of alcohol consumption
Failure to follow the operator’s instructions
Determination that the customer is physically or mentally unable to operate the vehicle safely
Illegal activities during the tour
In such cases, the tour will be terminated, and the customer will be required to return to the shop with no refund.
If the customer arrives significantly late for their reserved tour time, the booking will be treated as a cancellation.
If you wish to join a later tour, please contact the shop in advance to check if an alternative time slot is available.
If, for reasons attributable to the customer, you are unable to join another available tour,
the booking will be considered a same-day cancellation, and no refund will be issued.


Availability of the Service:
After completing payment,
customers may participate on the tour date indicated on the ticket. On-site payment is also available.

追加手数料:決済時には掛かりません。現地で追加の免責サービスに入る事が出来ます。1000円以下の費用負担になり選択出来ます。オプションの免責サービスに入らず、お客様の過失により車輛を破損させてしまった場合はノンオペレーションチャージとして50,000円(日本円)を払わなければなりません。その後、修理の為に必要な費用等を追加で精算しなければなりません。お客様の加入されている保険を利用出来る場合もありますが、適応外になる可能性もあります。

交換および返品、返金に関するポリシー:
体験日の前日日本時間12時迄のキャンセルはキャンセル料金が掛かりません。
キャンセルの申出は記載の電話番号またはメールアドレスに連絡をしてください。
前日日本時間12時1分以降はキャンセル料が100%掛かってしまいます。ご注意ください。

また、当日自然災害(大雨、雪、台風、地震等)による影響でツアーの催行が不可能な場合は全額返金致します。
しかし、お客様都合や理由による催行不可の際は返金が出来ません。
返金が出来ないお客様都合とは、パスポートや日本で有効な運転免許証の不保持、有効ではない(偽物を含む)IDを提示された場合、
飲酒されている場合、催行者の指示に従わない場合、運転をする事が能力的に困難であると認められた場合等があり、
また、その他催行中に関しても違法行為を行った者がいた場合は催行を中止し店舗へ戻ってもらい、返金は致しません。

また、予約した時間に大幅な遅刻をした場合はキャンセル扱いとなります。予約をしような場合は事前に店舗へ連絡の上、違う時間のツアーに参加可能か確認してください。
違う時間のツアーにお客様都合により参加出来ない場合は、当日キャンセル扱いとなります。

サービス提供時期:お客様は予約と支払いを完了した後に受け取るツアーチケットに記載の日時にツアーを体験出来ます。
前日や当日購入は記載の連絡先へ連絡の上、現地決済などを行ってください。

利用可能な決済手段:クレジットカード、ペイパル、店舗での現金払い等が可能です。

決済期間:決済はお客様が予約日に店舗でチェックインをする・又はした時間に処理されます。

価格:1.5時間ツアーは 13,000円(税込)
0.5時間ツアーは5,000円(税込)となります。
